This is an interesting issue for Originalists, those conservatives who believe that the Constitution should be understood as it was written, not interpreted by the Supreme Court. Do you agree with Rand Paul or the Constitution?

Republican Senate candidate Rand Paul is once again making waves, this time for saying he opposes citizenship for U.S. born children of undocumented immigrants.

The 14th Amendment to the Constitution guarantees citizenship to individuals born in the United States, but Paul's position is not an unpopular one in Congress.

Fourteen Amendment:

"Section. 1. All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

I haven't read on this amendment in great detail.


IIRC the intent here was to protect the rights of Freed Slaves after the end of the civil war.

I am not sure the writers of the amendment meant for that provision to encourage people to enter the country illegally and then benefit from breaking the law by their children getting citizenship and defacto allow their parents who broke the law to benefit from breaking the law.

I means if you steal something should you be allowed to benefit from your crime?

I disagree. Your logic could be applied to the 2nd, and then only black powder guns would be permitted. Not sure if there is an applicable SCOTUS decision on the birthright clause.

The right continues to try to erode rights. Big surprise. Next up is revoking the first amendment (they would surely have done this long ago if they could have gotten away with it.)
