Default Judges reject ban on animal cruelty videos..

My first thought is this the way the Fred Phelps, godhatesfags.com, freedom of speech case is going to go???.. 8-1 seems to be an oddity in the SCOTUS in this day and age.

The justices, voting 8-1, threw out the criminal conviction of Robert Stevens of Pittsville, Va., who was sentenced to three years in prison for videos he made about pit bull fights.

The law was enacted in 1999 to limit Internet sales of so-called crush videos, which appeal to a certain sexual fetish by showing women crushing to death small animals with their bare feet or high-heeled shoes.

Like the idea of the law since making the films involves breaking the law. It sounds as if the law was poorly written, based on comments in the decision. Hopefully the lnaguage can be tightened up to pass muster.

We just have to try to evaluate them the best we can."

The problem with this law was that the prohibition against showing the killing of any living animal did not distinguish between activities considered legal, such as hunting and fishing, and those such as dog fighting that have generally been considered illegal. If prosecutors wanted to follow the letter of the law, they could prosecute those making hunting and fishing videos such as dvd's of the old American Sportsman series.
