Career lawyers pursued the case for months, including obtaining an affidavit from a prominent 1960s civil rights activist who witnessed the confrontation and described it as "the most blatant form of voter intimidation" that he had seen, even during the voting rights crisis in Mississippi a half-century ago.
The lawyers also had ascertained that one of the three men had gained access to the polling place by securing a credential as a Democratic poll watcher, according to interviews and documents reviewed by The Washington Times.
The career Justice lawyers were on the verge of securing sanctions against the men earlier this month when their superiors ordered them to reverse course, according to interviews and documents. A Justice Department spokesman on Thursday confirmed that the agency had dropped the case, dismissing two of the men from the lawsuit with no penalty and winning an order against the third man that simply prohibits him from bringing a weapon to a polling place in future elections.
Gee, that will teach him, you can not bring weapons to any future polling places.........

Charges brought against three members of the New Black Panther Party for Self-Defense under the Bush administration have been dropped by the Obama Justice Department.
The charges stemmed from an incident at a Philadelphia polling place on Election Day 2008 when three members of the party were accused of trying to threaten voters and block poll and campaign workers by the threat of force -- one even brandishing what prosecutors call a deadly weapon.
The three black panthers, Minister King Samir Shabazz, Malik Zulu Shabazz and Jerry Jackson were charged in a civil complaint in the final days of the Bush administration with violating the voter rights act by using coercion, threats and intimidation. Shabazz allegedly held a nightstick or baton that prosecutors said he pointed at people and menacingly tapped it. Prosecutors also say he "supports racially motivated violence against non-blacks and Jews."

What is very interesting is that there is no information on this except from Fox News, and Washington Times.. the DOJ website does not list any information.. could this story be incorrect?? There is some information that it was dropped because of a technicality, but cannot find out what it was..

Sounds to me like these men should have been subject to criminal sanctions. The problem is that you have to have a law in place for them to violate. I'm guessing that since this was a civil case there wasn't a criminal law in effect. This leads me to wonder just how much we should spend giving these guys some sort of traffic ticket.
I'm all for making their actions some sort of misdemeanor or even a felony, but I don't want to drop a large sum of money slapping them on the wrist.
