Default Judge orders women to "not bear anymore children"

This is an interesting case:

http://www.statesman.com/news/conten...12salazar.html

On Sept. 5, state District Judge Charlie Baird sentenced Salazar, who had no criminal history, to 10 years of probation after she reached a plea bargain with prosecutors. In Texas, judges set conditions of probation. In addition to requiring Salazar to perform 100 hours of community service and to undergo a mental health assessment and setting other typical conditions, Baird told Salazar not to have any more children.

The women apparently did nothing while the father beat the child. (He is doing 15 years)
I'm not sure about the constitutionality of this. Although I've seen all kinds of things be set by judges as a condition of probation, this will make an interesting challenge (If she decides to challenge it).

I can only hope that he also makes it a condition of the father's parole (in 15 years).

The good news here, is that the child has been taken away from them, and hopefully is in a loving foster home now.

Gonna be an easy one for any decent appeals lawyer.. a better choice would have been lock daddy up longer, and to lock mommy up as she allowed it to happen.. neglect(not protecting your child) is often as bad as committing the act in question..

Judge just wants some face time, wonder if he is up for election soon???

States have cut so much money from human services budgets as the state administrators get their yearly raises. I'm no expert here but there needs to be some mandated guidelines so the case workers have lighter case loads.
