You are taking a small part of what happens occasionally in a town/municipality and making it the entire basis for something else - which doesn't really stand up in the grand scheme of the way things work.
No system is foolproof - no hospital, no fire department, no government, no bank, no fast food joint, no legal system, no child care, no school, no web site, no police department. It does not mean the systems themselves do not work or that the great majority of people will not be taken care of correctly.
So the courts say we cannot sue the police department for an occasional failure - that's a terrible thing, I agree - but then again, the courts have also decreed that we cannot sue the gun manufacturers, either, should they occasionally fail - do you agree that's a terrible thing, too?

You can sue hospitals, and banks, and fast food joints, and child care facilities....but you can't sue the police. Even when they are negligent. That's my point.
Actually, it was the federal legislature that decreed that we couldn't sue the gun manufacturers for the misuse of their product (as they shouldn't be). They could still be sued if they violate a state or federal statute or if their product is defective.
