No. Only the top two division winners get bye's. Last year Jacksonville had a better record than NE and had to travel for a playoff game. WC teams get very little in terms of positives for the playoffs.

The higher one finishes in the seeding generally the better.
If we beat the broncos last year we would have hosted the Steelers...
and I think everyone knows how that would have worked out for us...
First off, if they end up with the third best record, and one of the top two doesnt come from the same division, they would get a home game as division champion, the first week of the playoffs and play one of the two wild card teams.
Then the winners of the wild card games would play at 1 and 2, with the lower remaining seeded team playing at number 1 and the other at number 2.
So, lets say that the Pats at number 3 win their wild card game and then go and play number 2 while nuber 4, or the wild card team they played, whichever won goes and plays number 1.
If the Pats at number 3 wins their game against number 2, and the lower seed, either 4 or the wc team beats number 1, then the Pats at number three are the home team for the AFC Championship game as numbers 1 and 2 have been knocked out.
Now, if number 7 and number 8 play each other in China while the numbers 9 and 10 are idle, number 11 could sneak into......nah, never mind because then num,ber 11 would beat 12, and qualify to win 5 golden rings and a partridge in a pear tree.

If they have the 3rd best record in the AFC, that doesn't mean they're a wildcard team.
"Wildcard" teams are selected from the pool of non-division winning teams - the top two records advance to the playoffs.
For example, last year:

1 - Colts (South winner, 1st best record in AFC)
2 - Broncos (West winner, 2nd best record in AFC)
3 - Bengals (North winner, 4th best record AFC)
4 - Patriots (East winner, 6th best record in AFC)
5 - Jaguars (South runner-up, 3rd best record in AFC)
6 - Steelers (North runner-up, 5th best record in AFC)

Yes...No... Yes they Pats would get a bye...No wildcards never get byes...
No, the only way the Pats would get a bye with the 3rd best record in the AFC is if the top 2 teams were in the same division.
The last time I looked the Chargers and Broncos were in the same division..which WAS the original question..

The question was not stated correctly which was confusiong....originally..Yes they have to be in the same division of course...
